Business Identity

AROK Sailing School & Cruises provides instruction and recreational sailing activities in Northwest Arkansas and Northeast Oklahoma.

1. Acceptance of Terms

By accessing or using the website and services of AROK Sailing School & Cruises (“we,” “our,” or “us”), including booking a sailing lesson or cruise, you agree to be bound by these Terms and Conditions.

2. Services Provided

We provide sailing instruction, charters, and recreational cruises. All services are subject to availability, weather, equipment condition, and safety considerations at our sole discretion.

3. Bookings and Payments

- All reservations must be made through approved booking methods.

- Full or partial payment may be required to secure your booking.

- Prices are subject to change until confirmed.

4. Cancellation and Refund Policy

- Cancellations made at least two weeks in advance may be eligible for rescheduling or refund.

- No-shows or late cancellations may result in forfeiture of payment.

- We reserve the right to cancel or modify bookings due to weather, safety concerns, mechanical issues, or other unforeseen circumstances. Our liability is limited to rescheduling or refunding the amount paid.

5. Weather, Safety, and Operational Control

All trips are dependent on weather and lake conditions. The captain has full authority to modify, shorten, or cancel any trip for safety reasons. All participants must comply with instructions from the captain and crew at all times.

6. Assumption of Risk

You acknowledge and understand that sailing and boating activities involve inherent risks, including but not limited to:

- Slips, falls, and injuries on deck

- Sudden weather changes

- Equipment failure

- Drowning or water-related injuries

- Motion sickness or physical strain

By participating, you voluntarily assume all risks, known and unknown, whether caused by negligence or otherwise.

7. Waiver and Release of Liability

To the fullest extent permitted by law, you hereby release, waive, and discharge AROK Sailing School & Cruises, its owners, captains, instructors, employees, contractors, and affiliates from any and all liability, claims, demands, or causes of action for injury, illness, death, loss, or damage arising out of or related to your participation in any activity, whether caused by negligence or otherwise.

This waiver applies to:

- Personal injury or death

- Property damage or loss

- Delays, cancellations, or interruptions

Participants may be required to sign a separate liability waiver prior to participation. Failure to sign required waivers may result in denial of service without refund.

8. Indemnification

You agree to defend, indemnify, and hold harmless AROK Sailing School & Cruises from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising from:

- Your participation in activities

- Your violation of these Terms

- Your negligence or misconduct

9. Participant Responsibilities and Fitness

You represent that:

- You are physically and mentally capable of participating in sailing activities

- You will follow all safety instructions

- You are not under the influence of drugs or alcohol

- You will disclose any medical or physical conditions that may affect your safety

We reserve the right to refuse or terminate participation without refund if safety concerns arise.

10. Damage and Equipment Responsibility

You are responsible for any damage to vessels, equipment, or property caused by your actions, negligence, or failure to follow instructions. You agree to reimburse us for repair or replacement costs.

11. Limitation of Liability

To the fullest extent permitted by law, AROK Sailing School & Cruises shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of enjoyment, lost profits, or travel expenses.

In all cases, our total liability shall not exceed the amount paid for the specific booking giving rise to the claim.

12. No Guarantees

We do not guarantee specific conditions, routes, wildlife sightings, or experiences. Sailing conditions and experiences may vary.

13. Third-Party Services

We may utilize third-party providers. We are not responsible for their actions, omissions, or policies.

14. Intellectual Property

All website content is owned by AROK Sailing School & Cruises and may not be used without permission.

15. Privacy

16. Governing Law and Venue

These Terms shall be governed by the laws of the State of Arkansas or Oklahoma. Any disputes shall be resolved exclusively in the courts located within that state.

18. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of any changes.

19. Opt-out & Support Mechanisms

After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
